Having school online raises lots of privacy law questions under the Children’s Online Privacy Protection Act (COPPA) for children under 13 years of age. As a parent and an attorney, I like to keep an eye on what is being collected online and by whom, even if my kids are old enough to have this conversation and educate them on online safety. Most importantly, COPPA requires verifiable parental consent before collecting any personal information for children. Personal information under COPPA includes photos, recordings from children (visual and audio), etc. Also, parents want to know who is collecting the personal information, for what purpose and how is that information protected. Is it shared? If shared, with whom and why? These are some questions to consider as kids go back to school online.
