Have you ever seen “vote the as.….s out” on shorts’ label?

Would you buy the shorts with a political statement, even if nobody else can see it when you wear the shorts? 

How does this company get away with such advertising?

The beauty of such statement is that it is wide open to interpretation.  The consumer defines who the “as…..s” are that need to be voted out.  The company that makes these shorts, however, specified that “[f]or several years now we have used this to refer to politicians from any party who deny climate change is real….”

So, how does the company get away with such advertising?  Because this is a political statement on an issue that affects community wide, it is a protected speech under the First Amendment of US Constitution.  The FTC does not regulate political speech, only speech in commerce.
