If a TV station airs a political advertisement produced by an ad agency that paid for air time, can it be sued for the content of the political ad for false and misleading advertising?
This is NOT a political post!!!
The recently filed case, Donald J. Trump For President, Inc. v. Northland Television, LLC, d/b/a WJFW-NBC, raises the legal issue regarding advertising law and political ads. The President’s campaign is suing a TV station for false and misleading advertising and defamation claiming that the content in the airing political ad is false.
The FTC regulates Advertising laws in commercial settings. Political ads are not considered to fall within Advertising laws because such ads are considered free speech under the First Amendment. So, if political ads are protected speech, then can a TV station be sued for airing such speech?
What do you think?
